commission terms
Scope of Work
The Client should agree that the piece will only be for PERSONAL USE, NOT COMMERCIAL and will be according to the Artist’s art style (semi-realistic). The artwork done by the Artist pursuant to Client’s specifications shall be limited to, unless modified and agreed upon by both parties, the following, hereafter known as “the Commission”:
• original characters
• anime characters
• real people
• pets & mascotsWILL NOT DO
• backgrounds that are too complex
• NSFW/GORE (thinking about it)
• furry (thinking about it)For anything not stated here, client shall seek the artist for inquiry.
Deadlines & Completion
Exemptions can be made and deadline may extend depending on the season and complexity of work. Full illustrations with background will usually take longer.Should the client wish to set a deadline, there are options they can choose from in the client form (shortest waiting period is 3 weeks), but please note that they will not be strict and are only for basis.The final illustration shall be sent officially through email when the payment is made.
Payment
The Client shall pay the Artist through Paypal or Ko-fi, according to the price discussed. Clients may pay closer to the completion date, as long as payments are made before receiving the final Commission.Additional fee of $15-20 will be charged for revisions reflecting a new direction to the assignment or new conceptual input.
Rights & Permissions
The following rights shall be given to the Client upon receipt of full payment strictly for personal use:
• the right to display on any website
• the right to modify (in this case, the PNGs of the characters)
• the right to transmit through online platformsThe Artist retains the right to authorship credit, reproduction, and the right to display the Work in their portfolio (including, but not limited to, any website that displays Artist's works).When asked, Client must properly identify the Artist as the creator of Work. Client is not required the proactive duty to display Artist's name together with the Work, but Client may not seek to mislead others that the Work was created by anyone other than the Artist.
Termination & Compensation
Clients may terminate the Agreement at any time by notifying the Artist through direct messages. Upon such termination, Clients should agree to compensate the Artist as follows:1. Partial Completion. If Artist has partially completed the Work, Client agrees to compensate Artist at least fifty percent (50%) of the total price. If this Agreement is terminated by Client after Partial Completion, the Artist shall retain ownership of all rights of the artwork, including but not limited to completed artwork, sketches, and comps.2. Full Completion. If Artist has completed the finished artwork at the time of cancellation, Client should compensate in full price as otherwise provided in this Agreement.
